The Southern Poverty Law Center (SPLC) and its army of high-priced attorneys are frustrated that their attempt to destroy Liberty Counsel was not successful. Now that they were soundly defeated in the lower federal court, they want to appeal the case to further their lawfare against us.

 

Last month, a Vermont federal judge ruled against the SPLC in its frivolous lawsuit in which it accused Liberty Counsel of conspiring to help Lisa Miller flee the country with her child, Isabella, and escape the jurisdiction of the courts. The judge found there was ZERO evidence to implicate Liberty Counsel. The court also found that the suit by Janet Jenkins was barred by the statute of limitations.

 

But the SPLC’s agenda isn’t about winning this case on facts or the law. It’s about “destroying” our organization under a mountain of lawfare. They couldn’t beat us in the lower courts, so now they are preparing to appeal in hopes of crushing us with yet more legal work.

The SPLC represents a lesbian plaintiff who, irrationally and without any evidence despite years of litigation and scouring our files and emails, falsely claimed that Liberty Counsel participated in helping her former Vermont civil union “partner,” Lisa Miller, flee the country with Lisa’s biological daughter.

 

The SPLC’s client, Janet Jenkins, insisted she wanted Liberty Counsel to pay her a ridiculous and outrageous demand that began at 20 million dollars and escalated to a whopping 200 billion for something in which Liberty Counsel was not involved!

 

Liberty Counsel has been fighting this case for nearly a decade. It has consumed over 11,000 hours of legal work to clear our name, 186,000 documents and 25 depositions that included over 11,000 pages of exhibits and 6,800 pages of transcripts, and over 500 pages of arguments backed by thousands of exhibits to prove Liberty Counsel did nothing wrong.

 

Since its founding, the SPLC has made clear that its intention is to “completely destroy” conservative religious organizations.

 

“I want to say plainly that our aim is to destroy these groups, to completely destroy them,” SPLC fellow Mark Potok said in 2007.

 

In another setting that same year, Potok restated the organization’s quest, saying the SPLC’s mission is “trying to wreck the groups, and we are very clear in our head, this is — we are trying to destroy them … as a political matter, to destroy them.”

 

While the SPLC and Jenkins have not been able to bankrupt us, defending against the SPLC’s lawfare has put a serious dent in our legal fund. And now the SPLC is dragging us back to court for more.
